Gulf Hospitality Exhibitions & Conferences Organization, the owner of the registered electronic store ENJOY with commercial registration number 1118004010, welcomes you. We hereby inform you that below you will find the terms and conditions governing your use of this store and all the legal implications arising from your use of the store's services via this electronic platform. The use of ENJOY store by any person, whether as a consumer of a service, product of the store, or otherwise, constitutes acceptance and agreement from them, being fully legally, religiously, and legally competent for all the provisions of these terms and conditions. This agreement confirms your commitment to its regulations and provisions. This agreement applies to all types of transactions between the user and the store, except for transactions related to personal matters. This agreement is valid and effective once you agree to it and start registering with ENJOY store under Article 10 of the Saudi Electronic Transactions System.
- Introduction and Definitions:
The above introduction is an integral part of this agreement. Below you will find the meanings and definitions of the key phrases used in this agreement:
1. (Store) refers to the ENJOY store, which includes all forms of ENJOY store on the World Wide Web, whether it's an electronic application, a website on the internet, or a physical store.
2. (User) refers to any consumer who purchases a product or service from the store through its electronic platform.
3. (Agreement) refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
- User Legal Capacity:
1. The user acknowledges that they have legal capacity, religiously and legally, to deal with the store, or that they are at least eighteen years old.
2. The user agrees that if they violate this article, they will bear the consequences of this violation towards others.
- Nature of ENJOY Store's Commitment:
1. ENJOY store's commitment to consumers or users is to provide the (service or product).
2. ENJOY store may provide other services such as after-sales services or other related services, depending on the nature and type of the (service or product) requested by the user.
- ENJOY Store Usage Guidelines:
1. The user agrees to use the ENJOY store's electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2. The user, when purchasing a service or product from ENJOY store, agrees not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.
- Accounts and Registration Obligations:
Upon applying for membership in ENJOY store as a user, you are obligated to disclose specific information and choose a username and a secret password to be used when accessing ENJOY store's services. Therefore, you agree:
1. To be responsible for maintaining the confidentiality of your account information and password, and to notify ENJOY store immediately of any unauthorized use of your account information or any other unauthorized access to your confidential information.
2. ENJOY store shall in no way be responsible for any direct or indirect loss incurred by you, morally or materially, as a result of disclosing your username or password.
3. You agree to use your account or membership at ENJOY store yourself, as you are solely responsible for it. If someone else uses it, it indicates that you have authorized them to use the store on your behalf and for your account.
4. You agree to use ENJOY store seriously and credibly.
5. You agree to disclose true, accurate, updated, complete, and legal information about yourself as required during registration at ENJOY store, and you agree to update your information when it changes or as needed.
6. ENJOY store is committed to handling your personal information and contact details with complete confidentiality.
7. If ENJOY store finds that you have provided untrue, inaccurate, outdated, incomplete, or illegal information, or violated the terms of use agreement, ENJOY store reserves the right to suspend, freeze, or cancel your membership or store and your account on the platform, without prejudice to ENJOY store's other rights and legitimate means to recover its rights and protect other users.
8. If you fail to comply with any of the above, ENJOY store management has the right to suspend or cancel your store or membership, or block you from accessing ENJOY store services again.
Article 6 - Electronic Communications and Official Communication Channels:
1. The parties to this agreement agree that communication shall be conducted via the email or phone number registered on the platform.
2. The user agrees that all agreements, notices, data, and other communications provided electronically shall be equivalent to written counterparts, and shall constitute valid evidence, meeting regulatory and legal requirements.
3. The user agrees to the possibility of being contacted and informed of any provisions concerning this agreement or related dealings through ENJOY store management broadcasting general messages to all users or to specific users of ENJOY store.
- Amendments to the Terms of Use and Fees:
1. ENJOY store may notify you of any amendments to these terms in accordance with the official communication channels under this agreement, and by doing so, your obligations may increase or your rights may diminish based on any amendments made to these terms.
2. In the event of objection to any amendment to the Terms of Use, ENJOY store hopes that you will cease using its services, as simply logging into your account at ENJOY store or using ENJOY store constitutes acceptance of the amendments and full consent without reservation. ENJOY store accepts discussion on any suggestions regarding these terms.
3. All fees are calculated in Saudi Riyals, and the user is responsible for paying all applicable fees on the platform, in addition to any other expenses added by ENJOY store. Payment shall be made using the approved and available methods through ENJOY store.
4. ENJOY store may impose fees on some users depending on the offers, products, or services they request, or on any fees or taxes imposed by the state on the nature of the product or service.
5. ENJOY store reserves the right to add, increase, decrease, or waive any fees or expenses under the terms and conditions of the Terms of Use, for any of the users, regardless of the reason for their registration.
- Payment and Settlement Services for Stores in ENJOY Store:
1. ENJOY store, through its partners, provides a payment and settlement system in ENJOY store that can be entirely done online through the available payment options on ENJOY store or through any payment method provided by ENJOY store from time to time.
2. ENJOY store undertakes to specify the price of the service or product it offers in its store according to the prevailing market value.
3. ENJOY store undertakes to provide invoices, receipts, and acknowledgments for all amounts and profits arising in its store, and to provide the user with a purchase invoice for a service or product.
4. ENJOY store undertakes to provide accounting specifications recognized in its electronic store, in accordance with the provisions of this agreement and for the legal, economic, commercial, and organizational interests therein.
- Your Personal Information and Transaction Details:
1. The user acknowledges that they grant ENJOY store an unlimited, worldwide, perpetual, irrevocable, cost-free, and licensed right to use any personal information or materials provided or provided by the ENJOY store platform, or announced on the platform through joining or using it, through dedicated communication and registration forms, or through any email or communication channels available on the platform, to achieve any of the platform's interests.
2. The confidentiality provisions regarding consumer information are subject to the "Privacy and Information Confidentiality Policy" specific to ENJOY store, and to the provisions of this agreement concerning confidentiality.
- Intellectual Property:
1. The intellectual property rights of ENJOY store are fully owned by ENJOY store, whether owned by them before the establishment of this electronic platform or after its establishment.
2. The user or consumer respects the intellectual property rights of ENJOY store, including ENJOY store itself, and other words, logos, and symbols associated with ENJOY store or displayed on ENJOY store. ENJOY store and all rights related to ENJOY store are fully owned intellectual property rights of ENJOY store.
- ENJOY Store's Responsibility:
1. ENJOY store commits to conducting its business through this electronic platform in a lawful manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.
2. ENJOY store shall not be liable for any claims arising from errors or negligence, whether directly, indirectly, incidentally, by the user, or by a third party such as shipping companies.
3. ENJOY store and its employees, owners, and representatives undertake that the (service or product) is sound, legitimate, authorized according to the laws and regulations of the Kingdom of Saudi Arabia, and used for legitimate purposes.
- Confidentiality:
1. ENJOY store adopts tangible, organizational, and technical standards to protect users and prevent unauthorized access to users' personal information, and to preserve it.
2. As a user, you acknowledge that the internet is not a completely secure medium, and the confidentiality of your personal information cannot be guaranteed 100% through ENJOY store.
3. ENJOY store has no control over the actions of any third party, or outsider, such as other web pages linked through links to the platform or third parties claiming to represent you and others.
4. You are aware and agree that ENJOY store may use the information you provided to it for the purpose of providing services to you in ENJOY store, and to send marketing messages to you. Privacy at ENJOY store governs the collection, processing, use, and transfer of your personal identity information, subject to the "Privacy and Information Confidentiality Policy" specific to ENJOY store.
- Access Restriction or Membership:
ENJOY store may suspend or cancel a user's membership or restrict a user's access to platform services at any time, without notice and for any reason, without specifying a duration.
- Exchange Policy:
1. Without prejudice to the terms of the warranty agreement and regulations, the consumer has the right to exchange the product provided to them by ENJOY store within seven days following the receipt of the product, and they are not entitled to exchange the product after the expiration of seven days.
2. Exchange of the product requires the product to be contrary to what was ordered, in good condition, and the consumer has not used the product or obtained any benefit from it. ENJOY store has the right to inspect the product before exchanging it to ensure its safety.
3. The consumer is not entitled to exchange the product in the following cases:
- If the product was manufactured according to the consumer's request or specifications, except for products with defects or products that deviated from the specifications specified by the consumer.
- If the product is a service.
- If the products are purchased through installment programs and can only be exchanged for the same value or a higher value with payment of the difference, in accordance with the conditions mentioned above.
- If a defect appears in the product due to the consumer's mishandling.
- If the contract involves providing accommodation, transportation, food, or hospitality services.
- If the contract involves purchasing products from outside the Kingdom unless there is a difference in the agreed specifications and standards.
- Return Policy:
1. Without prejudice to the terms of the warranty agreement and regulations, the consumer has the right to terminate the contract and return the product provided to them by ENJOY store within seven days following the receipt of the product, and they are not entitled to do so after the expiration of seven days.
2. Return of the product requires the product to be contrary to what was ordered, in good condition, and the consumer has not used the product or obtained any benefit from it. ENJOY store has the right to inspect the product before returning it to ensure its safety.
3. The consumer is not entitled to return the product in the following cases:
- If the product was manufactured according to the consumer's request or specifications, except for products with defects or products that deviated from the specifications specified by the consumer.
- If the product is a service.
- If the products are purchased through installment programs and can only be exchanged for the same value or a higher value with payment of the difference, in accordance with the conditions mentioned above.
- If a defect appears in the product due to the consumer's mishandling.
- If the contract involves providing accommodation, transportation, or food.
- If the contract involves purchasing software download products online.
4. If the provisions of the return policy mentioned are available, the consumer has the right to terminate the contract and return the product to ENJOY store with a refund of the amount paid.
- Applicable Law or Regulation:
This Terms of Use agreement is governed and formulated in accordance with the laws, regulations, and legislation in force and applicable in the Kingdom of Saudi Arabia, and is fully subject to the regulations applicable to the authorities in the Kingdom of Saudi Arabia.
- General Provisions:
- If any provision or clause in this Terms of Use agreement is canceled or invalidated, or if there is any provision or clause in the Terms of Use agreement that is no longer effective, such an occurrence does not invalidate the validity of the remaining provisions, clauses, and terms in the Terms of Use agreement, and they remain valid until further notice from the management of ENJOY store.
- This Terms of Use agreement - which may be amended from time to time as circumstances require - constitutes the Terms of Use agreement, work mechanism, understanding, agreement, and contract between ENJOY store and the user. Both parties to this agreement agree that:
1. The Arabic language is the language applied in interpreting the provisions of this agreement or translating it into another language.
2. All prices displayed on services or products in ENJOY
